  • Applications for things like Conditional Use Permits, or Variances, Rezoning, General Development Plans, Preliminary Plats, Final Plats, etc… require a public hearing in front of the respective Township’s Planning Commission and/or Board. Those public hearings are of course open to the public.
  • TCPA staff prepares a report that explains and analyzes the criteria that must be met for the Planning Commission and/or Board to approve an application. You’ll find links to those Staff reports on this page.
  • Typically, you’ll find the Staff report(s) on this page about a week before the public hearing.
  • After the public hearing and once the Planning Commission and/or Board has made a decision, the Staff reports are removed from this page.

Rochester Township

An application for a preliminary plat consisting of 28.79 acres being subdivided into 10 single-family residential lots. The property was rezoned by the Rochester Township Board on November 10, 2021, to R-1, Low-Density Residential District. The development is known as Pavilion Estates. The Planning Commission will send their recommendations to the Town Board on the proposed preliminary plat, for final approval. The ten (10) lots, as proposed, are to be served by individual septic systems. Water supply will be provided by two (2) shared wells. The development includes a private roadway system that accesses the property via Boulder Creek Lane SW

Rochester Township

An application for a preliminary plat consisting of 63.91 acres to be subdivided into 15 single-family residential lots. The property was rezoned by the Rochester Township Board on January 13, 2022, from A-3 Agricultural District to R-1 Low-Density Residential District. The development is known as Woodland Valley Estates. The fifteen (15) lots as proposed will be serviced by individual wells and three (3) shared wells. The development will be accessed off of Meadow Crossing Road and will be developed as part of the township roadway system.

Salem Township

The owner/applicants have numerous tax parcels in this area, much of it contiguous. This request deals with two contiguous tax parcels together totaling approximately 118-acres; an 80-acre parcel that lies in the E1/2 of the SE1/4 of Section 16 and a 38-acre parcel that lies primarily in the NE1/4 of the NE1/4 of Section 21. The owner/applicants are requesting the subdivision of a two+ acre buildable non-farm dwelling parcel wherein the buildable area of the parcel would be within the SE1/4 of the SE1/4 of Section 16.

New Haven Township

An application for a variance to the non-farm parcel dwelling size on a 38.44-acre parcel of property zoned A-3; Agricultural District. The owner/applicants wish to subdivide the parcel into two – approximately equal size – buildable parcels. The A-3 ordinance allows three dwelling parcels in a quarter-quarter section but one of the parcels must be at least 35-acres in size. This variance would create three non-farm size dwelling parcels within the same quarter-quarter section, but the overall potential density would not be increased.

Appeal:

An appeal of a decision by the Township Zoning Administrator to deny an application for a conditional use permit to allow a home-based business within an R-1 Low-Density Residential District. The applicant desired to begin a home-based business located at 2491 Hawk Hill Lane SW. The business operation request included a spa, podcasting, music studio, and nutrition business along with manicures, pedicures, massages, and various facial services. The property is served by a shared well and individual septic system.

Denial was based on the application which included employees and other uses similar to a beauty shop which are not allowed within the Low-Density Residential District.

An application for a Preliminary Plat of 30.7-acres that are zoned R-1; Low-Density Residential and located in the south half of Section 06 of Rochester Township. The 30.7 acres will be platted into eight residential lots each served by an individual septic system. There will be two shared wells, each serving four homes.

Haverhill Township

An application for a zone change for a parcel about 136.11 acres in size. The property is presently zoned A-1 Agricultural Protection District, and the requested change is to A-2 Agricultural Protection District. A similar request was denied by Haverhill Township in 2018. According to the application, the rezoning would allow the applicant to subdivide the parcel as proposed in the application.

New Haven Township

Application:

An application for a variance to the accessory building size ordinance on a 5.5-acre parcel of property zoned R-1; Low Density Residential District. The owner/applicant wishes to build a 3,120 sq.ft. accessory structure. While the Homeowners Association Covenants allow accessory structures up to 3,000 sq.ft. in size, the R-1 ordinance limits the size of an accessory building, on a parcel larger than two acres, to no more than 1,500 sq.ft.. Therefore, the proposed accessory structure would require a variance to the ordinance of 1,620 sq.ft. A height variance would also be required. The height of the building measured by ordinance standards is 19.5 feet (actual height 23 feet). The ordinance allows for a height of 15 feet.

New Haven Township

Application:

Per Olmsted County records the owner – Baker Farms II, LLC – has four contiguous tax parcels in this area. The parcels lie in three different sections and together are comprised of 175+/- acres. In September of 2020 the New Haven Town Board of Adjustment granted a variance that allowed the 40-acre parcel that lies in the NE1/4 of the NW1/4 to be subdivided into a 10-acre dwelling site and a 30-acre residual. This current request is to add 20-acres – from the 30-acre residual – to the 10-acre dwelling site. This would leave a 10-acre residual that would remain contiguous to the rest of the land owned by Baker Farms II, LLC.
