  • Applications for things like Conditional Use Permits, or Variances, Rezoning, General Development Plans, Preliminary Plats, Final Plats, etc… require a public hearing in front of the respective Township’s Planning Commission and/or Board. Those public hearings are of course open to the public.
  • TCPA staff prepares a report that explains and analyzes the criteria that must be met for the Planning Commission and/or Board to approve an application. You’ll find links to those Staff reports on this page.
  • Typically, you’ll find the Staff report(s) on this page about a week before the public hearing.
  • After the public hearing and once the Planning Commission and/or Board has made a decision, the Staff reports are removed from this page.

Rochester Township

An appeal has been filed against the Planning Commission’s decision to deny the variances which would have been necessary to approve the preliminary plat as presented. The appeal will be considered by the Rochester Township Board at their regular meeting on July 14th, 2022 which is not a public hearing.

An application for a preliminary plat consisting of 28.79 acres being subdivided into 10 single-family residential lots. The property was rezoned by the Rochester Township Board on November 10, 2021, to R-1, Low-Density Residential District. The development is known as Pavilion Estates. The ten (10) lots, as proposed, are to be served by individual septic systems. Water supply will be provided by two (2) shared wells. The development includes a private roadway system that accesses the property via Boulder Creek Lane SW. This plat may include variances to the length of a dead-end road, private roadway, width to depth ratio, width at building line
and width of road frontage.

Rochester Township

Woodland Valley Estates –  An application for a final plat consisting of 63.91 acres being subdivided into 6 single-family residential lots and 4 outlots. The property was rezoned by the Rochester Township Board on January 13, 2022, from A-3 Agricultural District to R-1 Low-Density Residential District. The development is known as Woodland Valley Estates. The 6 lots as proposed will be served by individual septic systems and three (3) shared wells. The development will be accessed off Meadow Crossing Road and will be developed as part of the township roadway system. The outlots are being held for future development of an additional 9 lots.

Salem Township

The parcels that are part of this request all lie within the 40-acre SW1/4 of the SW1/4 of Section 30.

There are seven contiguous tax parcels – comprised of approximately 3.5-acres – that are owned by the South Zumbro Lutheran Church and all part of the Church property improved with the church buildings, cemetery, and grounds.

The owner has one tax parcel comprised of 34.69 deeded acres which are improved with a dwelling built in the 1800s.

The applicant wishes to purchase the property and is requesting the following:

1. Subdivide a 1.75-acre parcel along the east & south sides of the current Church parcel(s) and donate that parcel to the Church.
2. Subdivide the existing dwelling – temporarily – onto a 2.65+/- acre non-farm dwelling parcel.
3. Label the – then – remaining 31.84 acres as (N.B.) Non-Buildable for Dwelling Purposes.

The applicant proposes to give the owner a life estate in the dwelling and 2.65+/- acre dwelling parcel.

At the end of the life estate, the applicant will demolish the dwelling and donate the 1.84+/- acre parcel – which includes the immediate area around the dwelling – to the Church. (see yellow parcel on attached maps) and retain the .80-acres on the east end of the above-referenced 2.65-acre non-farm parcel (see orange parcel on maps) to recombine with his residual acreage. At that point, the applicant’s residual 31.04+/- acres will be considered the buildable non-farm dwelling parcel within that quarter-quarter section.

New Haven Township

Per Olmsted County records the owner – Elmer Stock – has several tax parcels in this area. The owner recently completed a sale of a portion of his property lying west of County Road #31/Riverview Road SE. It was assumed, because County Road #31/Riverview Road bisects the subject parcel from north to south, that the land on either side of the road had become separate parcels. That is not the case. This request then is to split the subject tax parcel so that the portion of the subject parcel that lies west of County Road #31/Riverview Road SE – approximately 27 acres – can be transferred to the buyer. This will leave a residual of approximately 46 acres with the Stock farm dwelling parcel.

Rochester Township

Application:

Millie Meadows Third Zone Change and General Development Plan  –  An application to rezone 41.09 acres from A-2 Agricultural Protection District to R-1 Low-Density Residential District in Section 29 of Rochester Township. The proposed development is east of Millie Meadow Estates and Mille Meadow Estates Second Subdivisions. As a part of the rezoning process, an application for a General Development Plan has also been submitted. The plan indicates a desire to plat 17 lots utilizing both public and private roadways. The property is currently listed as “Potential Suburban: on the Olmsted County Land Use Plan Map and is in the process of being considered for “Suburban” designation. The Olmsted County Planning Commission will conduct a public hearing on the request on August 4th, 2022.

The Planning Commission will send their recommendations to the Town Board on the proposed rezone and GDP, for the final decision.

Rochester Township

The owner/applicant(s) live next door to one another on Seasons Lane SW. W. Bruce and Lois B. Fye recently needed to upgrade the septic system located in their backyard. In moving construction equipment to the backyard, the contractor destroyed some trees and damaged the land on the Peter & Cindy Steffen property. To compensate the neighbors for the damage, Fye agreed to purchase the damaged area from Steffen.

The strip of land being transferred from Steffen to Fye will be 20 feet wide by 244+/- feet long and comprised of 4,880 sq.ft. or approximately .11 of an acre. The Steffen property is currently comprised of 2.49 deeded acres which does not include the road right-of-way. After the transfer, the Steffen parcel will be 2.38 acres which exceeds the two-acre minimum for a platted lot in the R-1; Low-Density Residential District.

No new parcels are being created.

Cascade Township

The second-phase final plat for a 98.01-acre parcel of property currently zoned R-1 Low-Density Residential District and Trails of Cascade Commercial Special District. This is the second phase of a three-phase development with the first phase containing; one commercial lot, 12 single-family residential lots, two outlots, and the lands that make up phases 2 and 3 respectively. This, second phase, is comprised of 25 single-family lots and one outlot.

When the 98.01-acre parcel was rezoned to R-1 and Special District the legal description included tax parcel 740313085989 which is located to the southwest on the west side of 18th Avenue NW/County Road #112 – this parcel should not have been included in the rezone. This public hearing will then also consider rezoning this parcel back to A-3; Agricultural District.

Salem Township

The owner has four tax parcels totaling approximately 190.22 acres. The applicant is seeking to subdivide a 3.67 +/- acre non-farm dwelling parcel in the SE1/4 of the SE1/4 of Section 4.

The total contiguous ownership is currently developed with the owner’s non-farm dwelling on 5.74 acres and a farm dwelling on the remaining 184.48 acres. The owner recently signed a parcel combination request to recombine the 5.74-acre non-farm dwelling parcel with the farm dwelling parcel. The ordinance allows two dwellings on a parcel that is larger than 80 acres.

The Salem Board, at their September 2022 meeting, approved the subdivision of a non-farm dwelling parcel in the NW1/4 of the SE1/4 for Steven & Michelle Lange. And in 2018 the Board approved the subdivision of a 6.11-acre non-farm dwelling parcel in the SW1/4 of the SE1/4 for Spencer & Kelly Klemm.
